Michigan OWI Laws

Under Michigan law, a person can be arrested for OWI if they are operating a vehicle and:

  • Their blood alcohol concentration (BAC) is .08% or more.
  • They are under the influence of drugs or alcohol.
  • They are impaired due to a medical condition.

A driver can be arrested for OWI even if their BAC is below the legal limit if they are impaired. This means that law enforcement can arrest a driver for a DUI even if they do not believe that the driver is intoxicated. If a driver refuses to submit to a chemical test, they can face stiffer penalties. A driver can be charged with a felony if they refuse to submit to a breath, blood, or urine test.

Zero Tolerance Policy for Underage Drivers

Michigan maintains a zero-tolerance policy regarding underage drinking and driving, punishing minors found driving while impaired by any level of drugs or alcohol with license suspension, fines, community service orders, and mandatory alcohol education courses.

Penalties for a DUI Conviction

  • A first-time DUI can result in a 180-day driver's license suspension, $500 in fines, and up to 93 days in jail. If a driver's BAC was .17% or more, they can face a one-year driver's license suspension, $700 to in fines, and up to one year in jail. If a driver's BAC was .17% or more and they injured or killed someone while driving, they can face a two-year driver's license suspension, $1,000 to $2,500 in fines, and up to one year in jail.
  • A second-time DUI can result in a one-year driver's license suspension, $200 to $1,000 in fines, and up to one year in jail. A second-time DUI conviction can also result in a vehicle forfeiture. 
  • A third-time DUI can result in a five-year driver's license suspension, $500 to $5,000 in fines, and up to five years in jail. A third-time DUI conviction can also result in a vehicle forfeiture.
  • A fourth-time DUI can result in a five-year driver's license suspension, up to $5,000 in fines, and up to five years in jail. A fourth-time DUI conviction can also result in a vehicle forfeiture.

What to Do at a DUI Stop

There are a few things to keep in mind if you are pulled over for OWI/DUI in Michigan.

You are being recorded.

Police officers have body cameras. The police car also has cameras and dash cams that will record everything that will happen when you are pulled over.

You do not need to say anything.

Silence is golden. The less you say, the less evidence the officer will have against you. You do not need to answer any questions. Anything you say can and will be used against you.

There is no need for you to discuss anything. Trying to explain yourself will only put you in a worse situation. If the police officer asks you questions and explains why you were pulled over, there is no need for you to make an explanation. 

By not saying anything and allowing the police officers to act based on the protocol that they are required to follow, you are not incriminating yourself. Keep in mind that you have the right to remain silent. Politely decline to answer questions.

Be polite and cooperative, but call your lawyer.
