What Is a Family Visa?
A family visa is a type of visa that allows U.S. citizens and lawful permanent residents to bring their family members to the United States. There are two main types of family visas: immediate relative visas and family preference visas.
Immediate Relative Visas
Immediate relative visas are available to the immediate relatives of U.S. citizens. There is no limit on the number of immediate relative visas that can be issued each year. Immediate relative visas are available to the following individuals:
- Spouses of U.S. citizens
- Unmarried children under the age of 21 of U.S. citizens
- Parents of U.S. citizens (the U.S. citizen must be at least 21 years old)
Family Preference Visas
Family preference visas are available to the family members of U.S. citizens and lawful permanent residents. There is a limit on the number of family preference visas that can be issued each year. Family preference visas are available to the following individuals:
- Unmarried children over the age of 21 of U.S. citizens
- Spouses and unmarried children of lawful permanent residents
- Married children of U.S. citizens
- Siblings of U.S. citizens
Family preference visas are issued in the order in which the petitions are filed. The wait time for a family preference visa can be several years.
What Is a Marriage Visa?
A marriage visa is a type of visa that allows U.S. citizens to bring their foreign spouses to the United States. There are two types of marriage visas: the K-1 visa and the CR-1 visa.
K-1 Visa
A K-1 visa, also known as a fiancé(e) visa, allows a U.S. citizen to bring their fiancé(e) to the United States for the purpose of getting married. The couple must get married within 90 days of the fiancé(e) entering the United States. After the couple gets married, the foreign spouse can apply for a green card.
CR-1 Visa
A CR-1 visa, also known as a marriage visa, allows a U.S. citizen to bring their foreign spouse to the United States. The couple must be legally married. After the foreign spouse enters the United States, they will receive a green card.
How Long Does It Take to Get a Family or Marriage Visa?
The length of time it takes to get a family or marriage visa depends on several factors, including the type of visa and the relationship between the petitioner and the beneficiary. In general, immediate relative visas are processed more quickly than family preference visas. The wait time for a family preference visa can be several years.
