You may already be familiar with the concept of a jury trial, but several things must happen before you have your day in court. This can be a long, arduous process, and you should know what to expect. Depending on the circumstances (including whether you hire a seasoned criminal defense attorney), your case may not need to go to trial at all.

Most criminal defense cases involve the following steps:

  • Arraignment. The arraignment is your first appearance in court before a judge. At this stage, you will only enter a plea: guilty, not guilty, or no contest.
  • Pre-trial. This phase encompasses all of the preparation that goes into building your case before your formal trial. It includes research, discovery, sourcing expert testimony, deposing witnesses, and developing defense arguments. It may also include negotiating with prosecutors to secure an acceptable plea bargain or even attempting to get the case dismissed on certain grounds.
  • Trial. If we cannot get your case dismissed or negotiate a plea bargain, we will defend you in court before a jury.
  • Verdict. After the defense and the prosecution make their respective arguments, the jury will deliberate and issue their decision.
  • Sentencing. If you are found guilty by the jury, the judge will decide your sentence, which may include incarceration, fines, and other punishments.
  • Appeals. You may have the right to appeal an unfavorable verdict on certain grounds, such as if a significant legal error compromised the proceedings.

Our team is prepared to defend against a wide range of criminal charges. However, we do tend to handle certain types of criminal offenses more than others.

Our Warren criminal defense attorneys frequently represent defendants in cases involving:

  • DWI/OWI. If you were pulled over and charged with operating while intoxicated (OWI), also known as driving while intoxicated (DWI), you could be facing a lengthy license suspension, costly fines, and even incarceration. An OWI conviction can affect your current employment situation as well as make it tougher to secure future professional opportunities. No matter what happened, we can work to mitigate these consequences and seek the most favorable resolution possible.
  • Drug charges. If you have been charged with the possession, distribution, or manufacturing of drugs, the penalties you face could be substantial. A conviction can in some cases result in up to twenty years of prison time and up to $50,000 in fines. Convictions may also also lead to the loss of certain rights such as voting and owning firearms. We provide aggressive legal representation to those accused of drug crimes and are well-versed in how prosecutors approach these cases.
  • Weapons charges. Weapons offenses also come with significant penalties, including jail time, enormous fines, and a loss of certain rights. These charges are often pursued in conjunction with other alleged offenses, such as domestic violence charges or drug charges. Our team understands what prosecutors must prove to obtain a conviction and will work to defend you against each individual charge you are facing.
  • Domestic violence charges. Many domestic violence charges are the result of an overreaction or simple misunderstanding. Police only need a “reasonable suspicion” that an act of domestic violence has occurred to make an arrest, and even if the alleged victim recants their allegations, the prosecution can still choose to move forward. We recognize the sensitivity of these charges and will work to build a strong defense.

If you are arrested for a crime, exercise your right to remain silent and continue to ask to speak to an attorney. Then, get in touch with Haque Legal – our team is available 24/7 to take your call.
