Defending Sex Crimes In Michigan: Part One

As lawyers we would like to believe that we have seen it all. Haque Legal has handled a lot of cases that cover either defense or the prosecution of cases.

Sex crimes is one category that we find very entertaining to defend more than prosecute. When the thing already speaks for itself and the evidence is somewhat here it is more challenging for lawyers to find the right defense and make sure that he gets his client off the case.

Here at Haque Legal, we always want a holistic take on things, which is why we believe that defending sex crimes in Michigan is an experience and a strategy that we want to share with everyone.

With that, this article aims to look at and share how we can defend sex crimes in Michigan.

What are the defenses that can be used for sex crimes in Michigan?

As we’ve said above defending sex crimes in Michigan is very interesting. Other than the fact that we are not faced with a lot of emotions coming from either side of the parties it is very interesting to see and defend sexual conduct.

We have to clarify: defending sex crimes in Michigan is only very interesting when talking about sex crimes where consent is not an issue. The very heinous and serious sex crimes are devastating to handle, even for your lawyers.

With that, we will only touch on the defenses that are often used for defending crimes related to solicitation, prostitution, pimping, pandering, and other related crimes under Michigan law.

No “knowing” or knowledge of payment

One of the most common defenses used for sex crimes in Michigan is the no “knowing” conduct. Based on definition, knowing is defined as having a reasonable cause to believe. As a defense, it means that there was no knowledge on the part of one of the parties that sex is being offered only in exchange for payment.

Let us give you an example

In some cases there are instances when one party absolutely has no idea about the offer of sex for money.

  • A man picked up a woman in the bar without any knowledge that the woman is a prostitute. In this case the man can say that he had no knowledge that money is the exchange for the sexual act.
  • A woman was picked up by a man in a public place after having coffee and discussing current affairs without the knowledge that the man is offering a sexual act in exchange for money.
  • Picking a woman, who is a hitchhiker, and you later on hit it off and had sexual acts done to each other is also possible after all.

In both instances the fact that the person receiving the sexual conduct has no knowledge of the fact that money is needed for the sexual act to be pursued then it can be used as a defense by the person.

Why is “not knowing” a defense?

Not knowing that money is being offered or needed for the sexual act is a defense because in order to convict a person of pimping, the prosecutor is required to prove the knowledge that money is being exchanged for the act is present in the circumstances.

Can I just deny the knowledge?

You cannot simply deny the knowledge of the fact that the sexual acts were not paid. You should keep in mind that you need a lawyer to make sure that your denial is not just an empty denial.

An empty denial is something that you should watch out for. You cannot simply deny the knowledge that there is a need for cash for the sexual conduct. You cannot simply deny the knowledge, you need a lawyer who can help you with the denial and everything.

A mere denial in law is not enough. You should have a lawyer who can help you with this specific thing.
