What do you do after being granted an HYTA Status in Michigan?

Eligibility to the HYTA Status is one of the best improvements that you may want in life. What do you do so you do not waste such a miracle?

As we have said in the first part of this series, we all make mistakes. As the law becomes fully aware of the circumstances of the youth while growing up it becomes more and more lenient when it comes to forgiving the offences and the youthful mistakes of individuals. Michigan’s Holmes Youthful Trainee Act (HYTA) is the perfect example of how mistakes can be forgiven, forgotten, and set aside.

With that, let us continue to look at what Michigan’s Holmes Youthful Trainee Act (HYTA) means today as well as how you can get an HYTA disposition and all other helpful information.

Life After HYTA Status

After you have been granted the HYTA status you have been looking for, you must know your life after getting it.

If you have been granted conditions to continue enjoying the HYTA status, you should do your best to follow all of the conditions that have been set for you. Whether the conditions are set for you to comply with before the grant of the status or after, there are some things that you may still be required by the judge to do.

Get Drug Tested Randomly

Random drug testing is often required by the judge to make sure that you will not go astray. Random drug testing is important for you to check out all of the aspects that are necessary for your rehabilitation.

It always bears repeating that you are only given a second chance in life through the granting of the HYTA status. Keep in mind that you will always need to show that you are doing your best to be a better part of society. You are required to prove that you are doing what you can to better yourself as a member of society. If you were able to show that you are indeed a person who has made sure that you will have everything that is required of you then you’re proving that you are worth the second chance that has been given to you.

Get Alcohol Tested

If your violation or your offense is relating to an offense that is triggered by alcohol and such, the judge may require that you be tested for alcohol consumption randomly. This applies specifically to those who have been charged with an alcohol-related offense while they should not be drinking at all. Those who are between the ages of 18 to 21 are the ones who may be targets of this specific testing.

Maintain Proper Employment

Offenders who are required by law to be part of those who have HYTA status may also be required to always maintain proper employment while they are enjoying the HYTA status.

Being employed is an important showing or indicator that you are indeed moving forward as a member of society. When you can maintain proper employment you are showing that you are responsible and disciplined enough to join society as a member and the judge or the court should not fear you joining society as a completely free individual.

Attend High School or Get Higher Education

A judge is also a person who wants you to do better. As long as you fall on the requirements set by the law, judges would often help fight for your rights in getting a second chance. For you to get your life back together one of the requirements may be that you attend high school or get higher education for your future.

Denied HYTA Status

As we have repeated, the HYTA disposition is discretionary on the part of the judge. The judge is not required, in any way, to approve the application for HYTA status and should never be forced to do so.

In some instances, however, the judge would have no choice but to deny the HYTA status application because the case falls under any of the following offenses:

  • When the individual is involved in drunk driving;
  • When the individual is involved in traffic offenses;
  • When the individual is guilty of an offense relating to major controlled substances in Michigan’;
  • When the individual is guilty of criminal sexual conduct; and
  • When the felony that the individual is guilty of carries a maximum penalty of imprisonment.

Do I need a lawyer to handle my HYTA case?

Yes, you need to have a lawyer who can handle your case especially in terms of the legal geography and the strategy that you need to play for you to get a favorable HYTA decision from the court.

Keep in mind that granting you this status is not mandatory on the part of the court but it is discretionary. There are still requirements and terms that you should comply with for you to get the protection that is provided for by the HYTA status.
