Independent Medical Examination in Insurance Claims in Michigan

In the previous article, we discussed attending a mental and physical examination as a way to filter out fraudulent claims in the State of Michigan and insurance claims.

We have discussed Michigan Court Rule 2.311 which provides that when the mental or physical condition of a person is in controversy, the court may order the party “to submit to a physical or mental or blood examination by a physician or to produce for examination the person in the party’s custody or legal control.” This applies to both insurance claims and even to slip and fall cases.

In this article, let us discuss more information about the independent medical examination in insurance claims in the State of Michigan.

What does the IME requirement mean?

The Independent Medical Examination (IME) is a requirement when an individual files a lawsuit for damages following a personal injury. Here, the defendant is entitled to ask the plaintiff to submit to the exam to know the veracity and the truth of the medical claims.

The doctor tasked to do the IME must prepare a report of his findings. He must be ready to present his findings in court and explain the results of the tests done as well as the conclusions that come from them.

What should be your expectations in the IME?

During your IME, you should keep in mind that you are not in a clinic for your own sake. You will not be building a doctor-patient relationship. You are not with your doctor. You need to be careful of what you say and the claims that you state. In case of doubt, you should consult with your lawyer first before you agree to go or before you go to the IME required by your insurance company.

Quick Tips from Haque Legal

Before you have a chance to consult with us, we have a couple of pieces of advice that we want to tell you.

First, you will receive a letter from the insurance company for the medical examination. This letter will require that you bring your medical records to the examination. You should not do this.

The only thing that you need to bring to the examination is yourself. There is no need to provide any medical records of the past and the insurance company is the one required to get your records themselves.

If you receive the letter, you can always ask Haque Legal for a consultation before the examination.

Next, the examination will not take a long time. This is the reason why you do not need to present anything else other than yourself. Most examinations are barely examinations and there is nothing difficult about it.

The doctor will ask you some questions about the accident, how the accident occurred, and the changes that have happened in your life. A physical examination is quick, so you should not have a lot of problems answering the questions.

Some doctors will ask a lot of questions about your health before the injury. Typically, you need to answer most questions but mostly about how the incident occurred.

For Haque Legal clients, we say that you do not need to get into much detail about the accident during the exam. Your doctor is not entitled to know anything that is not related to your health and you are not required to answer any of his questions that are not related to your health.

Finally, the best tip we can give you is to contact us as soon as you get into a car accident in Michigan. This way, we can help protect you and your rights.
