How Does An Insurance Company in Michigan Investigate An Auto Accident?

An insurance company has the right to go after individuals who claim to be in an auto accident in Michigan and find out that they are not. Insurers can properly assert and preserve a fraud defense.

In recent Supreme Court Decisions, Michigan State has devised a list of methods of investigation claims and they include different methods.

In this article, let us discuss some of the circumstances that you should know when it comes to the investigation process done by insurance companies.

Investigation of the Claim

Michigan Assigned Claims Plan (“MACP”) and no-fault insurance policies in the State of Michigan require that the insured or any other person who is claiming no-fault benefits must cooperate with the insurer’s investigation.

The investigation of the claim may begin before litigation commences and can be implemented after the litigation has been initiated.

Coordinating with the insurance company is always a good idea. If you are being investigated for a claim, however, we recommend that you always look for a lawyer who can help you out.

Process of the Investigation

Generally, the following are the steps that jurisprudence in Michigan allows as steps to take in the process of the investigation:

  • Obtaining affidavits regarding proofs for coverage;
  • Completing signed applications for benefits;
  • Signing authorizations for the release of school, employment, medical records, etc.;
  • Attending a mental and/or physical examination;
  • Submitting to unrecorded and/or recorded interviews conducted by the carrier or its agents; and
  • Submitting to examinations under oath.
  • While not an action that requires cooperation from the insured or claimant, insurers may also conduct surveillance to investigate the claim.

These steps will be discussed in the next article of the series. They are also known as tools to filter out fraudulent claims.

In case of doubt, keep in mind that it is your no-fault insurance provider who would ultimately pay for your medical bills. As long as you get unlimited or no-limit coverage, you should be properly covered at a time when you need the best kind of coverage for your health and safety.
