WHAT IS A MISDEMEANOR VS A FELONY DRUG CHARGE?

There are two degrees of drug charges under Michigan law: felony drug charges and misdemeanor drug charges.

  • A felony drug conviction usually requires at least one year in prison. You will also lose the right to vote and the right to own a firearm for 3-5 years after your prison sentence.
  • A misdemeanor drug conviction is usually earmarked by fines and a max jail sentence of one year or less.

WHAT IS A DRUG CHARGE?

In Michigan, a drug charge can be any number of things. Each class of drugs carries with it a different sentence and penalty. Some of the most common drug-related offenses include:

Possession of prescription drugs: Possession of up to 25 grams of schedule I or II drugs can land you up to 4 years in jail and fines of up to $25,000.

Distribution of prescription drugs: If you are charged with distribution of prescription drugs you could find yourself facing up to 40 years in prison with potential fines of up to $250,000

Possession of Cocaine: Possession with the intent to sell is a felony in Michigan. You could face up to 20 years in prison and/or $25,000 in fines for under 50 grams. The larger the amount you’re caught with, the more jail time and fines you could get.

Heroin Possession: If you are charged with possession of under 50 grams you could face up to 4 years in jail and $25,000 in fines.

WHAT ARE THE DRUG LAWS IN MICHIGAN?

Under Michigan Law, drugs fall into five categories:

  • Schedule I: Schedule I drugs include marijuana, LSD, MDMA, and Heroin. These substances have a high potential for abuse and aren’t accepted for any medical use.
  • Schedule II: Schedule II drugs include cocaine, opium, morphine, oxycodone, and meth. These substances have a high potential for abuse but have medicinal uses in the medical community.
  • Schedule III: Schedule III drugs include low-grade morphine, anabolic steroids, ketamine, and codeine mixtures. Schedule III drugs have less of a potential for abuse but abuse can lead to physical or psychological dependence.
  • Schedule IV: Schedule IV drugs are Ambien, valium, Xanax, Rohypnol, Zolpidem, Soma, Darvon, etc. These drugs have less of a potential for abuse, are regularly accepted in the medical community, and may lead to abuse or dependence.
  • Schedule V: Schedule V drugs include cough syrup, Lomotil, Motofen, Lyrica, etc. Schedule V drugs are limited quantities of narcotics that have the potential for abuse
