Timeline On Your Fiancé Visa

A K-1 Visa is not an easy thing to get. There are a lot of circumstances that affect the timeline and some considerations that the United States Citizenship and Immigration Services have to go through before it gets approved.

Here at Haque Legal, it is our goal to make sure that we put a timeline on your K-1 visa and make sure that you are ready for the time it would take to get it.

With that, let us begin answering your questions on the timeline.

How long will the K-1 visa take?

On average, the K-1 visa will take an average of 5 months to 7.5 months. This would depend primarily on how well you fill-up the form and your documentary submissions. As a warning, keep in mind that there is a pandemic and some offices of the USCIS are not open to the public. Take this into consideration when you are planning to get a K-1 visa.

Is the USCIS the only government agency that assesses the K-1 visa?

No, the USCIS is only the first agency that handles the processing of the K-1 visa but the National Visa Center (NVC) also handles the processing of the visa. In this case, you should allow an additional three to four weeks to receive the instructions from the National Visa Center (NVC).

How do I file?

To get the process, and the timeline, started you must file Form I-129F but that is not the only thing that you need to do. The following are some of the things that you should do, according to the USCIS website:

Read the Form I-129F, Petition for Alien Fiancé(e) Instructions

The first thing that you need to do is to read the instructions related to your VISA application. Whatever you do, you should never forget that reading the instructions on the form is the most important thing that you need to do to make sure that you are doing the right thing and following the right instructions.

If you think that you are just going to have a hard time with the reading, you should hire an immigration lawyer to help you out. This is where the Southfield immigration lawyer in Haque Legal can help you. We specialize in immigration so you do not have to worry too much about it.

Complete and sign your Form I-129F

You should complete and sign the form after reading the instructions well. Again, if you think that you cannot do it on your own, the important thing to do is to hire an expert who can help you in the matter.

Pay the filing fee, if applicable

The next thing that you need to do is to pay the filing fees that are required of you. Your lawyer can also help you with this if you hired one to assist you in the process.

Provide all required evidence and supporting documentation.

You have to provide all the required evidence and the supporting documentation that comes with your application. Any claim that you have on your form cannot be a mere claim, it must be substantiated at all times. The documentation that you present will be necessary. They must be authentic and you must be prepared to explain or discuss them at the time of the interview.

What happens after I file?

Of course, the things that happen after you file are another thing to consider. What does the USCIS do with the form? Why are you going to wait for almost one year before you get the visa? Let us answer this question:

According to the USCIS, once we receive your Form I-129F, you should expect the following:

  • Receipt notice confirming we received your petition;
  • Biometric services notice, if applicable;
  • Notice to appear for an interview, if required; and
  • Notice of our decision.

This will be discussed in the next part of this article series.
