Disorderly Person – Common Prostitute (MCL 750.167)
A disorderly person is considered a person who is a common prostitute. It is a misdemeanor offense that is punishable by up to 90 days in jail or with a fine of up to $500 or both.
A person is guilty of being a disorderly person when he or she is “being” a prostitute or loitering where the prostitution occurs. It does not require that the act of prostitution occur.
Soliciting, Accosting, or Inviting to Commit Prostitution or an Immoral Act (MCL 750.448)
A person is guilty of the crime when he solicits, accosts, or invites another person in a public place or in or from a building or vehicle, by a word, gesture, or any other means, to commit the act of prostitution or any act that constitutes prostitution.
This is punishable by the following penalties, depending on when you committed the offense:
- First Offense: Misdemeanor conviction punishable by up to 93 days in jail or a fine up to $500.00, or both. MCL 750.451
- Second Offense: Misdemeanor conviction punishable by up to 1 year in jail or a fine up to $1,000.00, or both. MCL 750.451.
- Third Or Subsequent Offense: Felony conviction punishable by up to 2 years in state prison or a fine up to $2,000.00, or both. MCL 750.451.
Admitting to place for prostitution (MCL 750.449)
The crime of Admitting to a place for prostitution is committed when a person who is 16 years of age or older receives or admits another person into a place to commit acts constituting prostitution or committing prostitution. The acts of lewdness or assignation are also covered acts under this law.
Generally, an individual is guilty of a crime punishable as follows, depending on the severity of the offense:
- First Offense: Misdemeanor conviction punishable by up to 93 days in jail or a fine up to $500.00, or both. MCL 750.451.
- Second Offense: Misdemeanor conviction punishable by up to 1 year in jail or a fine up to $1,000.00, or both. MCL 750.451.
- Third Or Subsequent Offense: Felony conviction punishable by up to 2 years in state prison or a fine up to $2,000.00, or both. MCL 750.451.
Engaging Services For Purpose Of Prostitution, Lewdness Or Assignation (MCL 750.449a(1))
Engaging services for prostitution, lewdness, or assignation occurs when a person engages in such acts with another person for prostitution. This is a misdemeanor crime and is punishable by up to 93 days in jail or a fine of up to $500.00, or both. A person convicted of this offense is subject to infectious disease testing as required by law.
When this act is committed against a person who is below 18 years of age, he can expect that he will be punished with a penalty of up to five years in state prison or a fine up to $10,000.00, or both.
